RETAIL
SOFTWARE VS OEM SOFTWARE
|
A great deal of confusion exists about
the differences between retail software
and OEM software. I cannot possibly
count the number of times I have been
asked, "what is OEM?" Below
I will explain the differences between
the two and how they affect you as a
consumer.
Packaging
As expected, the
retail software comes packaged
in a nice retail box as you would
find in your local retail stores.
In order to cut costs and offer
this same software at a lower
price, Microsoft packages their
software in the OEM version which
does not include all the nice
retail packaging. The OEM version
is also factory sealed but does
not include the fancy retail box.
Licensing
One legality common to all Microsoft
operating system software is that
the software can only be legally
installed and registered on one
computer at a time. Microsoft
does NOT allow the purchase of
one software license for installation
on multiple systems. For example,
if you have two systems that require
Windows 7 Pro, you would need
to purchase two copies. You cannot
purchase one copy and install
it on both systems.
With that said, lets move onto
the licensing differences between
Microsoft retail and OEM software.
The
retail version can be uninstalled
and reinstalled on any computer
now and in the future whereas
the OEM version can be legally
installed and registered to one
computer only.
For example, you want to sell
your computer system. With the
retail version, you can uninstall
the software from the system you
are selling and then reinstall
it on any other computer of your
choice. However, with the OEM
version, the software must remain
with the computer you installed
it on and are selling. OEM software
cannot be uninstalled from the
original computer you installed
it on and then reinstalled on
a different computer system.
Another difference between the
two is that the retail version
comes with the product key code
stamped on a sticker which is
glued to the install guide. This
product key code remains with
the install guide and is not intended
to be removed. The OEM version
comes with a removable COA sticker
with the product key code and
should be removed and applied
directly to the PC case. This
ensures that this particular PC
will always have that product
key code in the event the system
is sold.
Support
All Microsoft retail software
includes one year of Microsoft
technical support. Microsoft does
not provide technical support
for the OEM version and expects
the reseller to provide such services
to the buyer. |

As I mentioned above, this version
can be legally installed on
any single system. However,
once installed on a particular
system, the software must remain
with that system and cannot
be legally installed on a different

COUNTERFEITING
AND BRANDING
|
|
When
it comes to all Microsoft software,
I personally believe there is nothing
more important than educating everyone
regarding the ever growing problem
of counterfeit and branded software
on the market today. I cannot begin
to express my frustration and anger
in relation to all the counterfeit
and branded software being sold by
online resellers. In this section,
I will first address counterfeit software
followed by branded software and tell
you what most resellers don't want
you to know!

Counterfeiting
|
Introduction and origins of counterfeit
software
Today,
the software industry's largest
threat comes from counterfeiters
closely followed by sellers of branded
software. With the ever growing
increase in technology, counterfeiters
continue or should I say attempt
to replicate an exact copy of all
Microsoft's software. The majority
of this counterfeit software is
manufactured in Asia where they
have very weak anti-piracy laws.
This software is then channeled
to the United States where it can
be sold to unsuspected buyers though
questionable web sites, auctions,
and local swap meets.
The majority of legitimate online
resellers do not become victim to
counterfeit software because they
as we, do not purchase outside the
Microsoft channel. During the first
quarter of 2011, I had a conversation
with a Microsoft anti-piracy team
leader and she explained to me that
90% of the Microsoft software being
offered on popular auction web sites
were counterfeit. This only goes
to show you how prevalent this problem
has become in our market today.
With each passing year, counterfeiters
fine tune their methods with advances
in technology and simple trial and
error. Today, the average consumer
is easily fooled and hence they
become one of millions of unsuspecting
victims.
When today's consumer purchases
Microsoft software, most are not
aware of the ever growing problem
of software counterfeiting. They
simply receive their software which
to them looks like any other software
they purchased in the past and install
it. Sure at first the buyer is not
confronted with anything suspicious.
However, 3 to 6 months later the
buyer is looking at their desktop
and is shocked to see a box stating
that their Windows is not genuine
and they are a victim of counterfeiting!

At
this point Microsoft is fully aware
that you are running a counterfeit
version of Windows and shuts down
important operating instructions.
There is some good news, Microsoft
kindly gives you a link to purchase
the real version of Windows directly
from Microsoft at a high market
price.
Personally I have heard the above
story so many times I cannot come
close to counting them. A common
question I get from these victims
is, why did my system work for so
long without any problems and then
all of a sudden I get this notice?
Is it a mistake on Microsoft's end?
The answer to this is no. It takes
a considerable amount of time for
Microsoft to determine what product
registration key codes are being
used with the newest release of
counterfeit software. Its not a
simple task I would care to be involved
in. However, I give kudos to all
the Microsoft anti-piracy team members
who put all those hours into their
work!
Now that I have reviewed the horror
story of thousands of counterfeit
victims, lets move on and cover
the telltale signs of how to spot
Microsoft counterfeit software.
How to
spot counterfeit Microsoft software
Let me first start off by saying
that counterfeiters are always updating
their techniques. What's easy to
spot one year may be very difficult
the next. However, if you follow
the guidelines below, I am 100%
confident you will never experience
the horror story I presented above.
Lets get started!
The following guidelines hold true
for all Microsoft software. Whether
it be Windows, Office, Server, or
any other Microsoft software, the
same counterfeit techniques are
used.
CERTIFICATE OF AUTHENTICITY
Lets begin with the packaging and
how we can determine if the software
is counterfeit prior to opening
it. Microsoft has done a fantastic
job manufacturing their COA (certificate
of authenticity) and making it very
difficult to replicate. For obvious
reasons I do not know the technology
used to manufacture their COAs and
am easily convinced that counterfeiters
do not have this knowledge either
:)
All Microsoft COAs contain a security
thread which is interwoven through
the COA. This thread appears as
if it is part of the paper itself
and can be seen rising from the
paper and then back into the paper.
Its a difficult process to explain
but one way to understand its properties
is to imagine a piece of paper with
a metal thread embedded into it.
As you observe the paper, it appears
that the metal thread is actually
part of the paper itself. However,
as you follow the thread you will
also notice that the metal thread
appears to come out of the paper
and position itself over it. That
is the best way I can put this process
into words. Its a very complicated
process which counterfeiters have
yet to successfully replicate. Of
all the counterfeit versions I have
personally viewed, the best the
counterfeiters can do is cut small
holes into the paper and run a foil
through them to appear as if its
threaded into the actual paper.
Figures 4 and 5 represent authentic
Microsoft COAs.
The
above figures demonstrate how the
thread is interwoven into the paper.
As you can see, the thread begins
its travel inside the paper. When
I state inside the paper, the actual
thread is part of the paper. Its
not positioned behind it but actually
inside it. Farther down its travel
it then comes out of the paper and
then back in. Microsoft refers to
this technique as foil interwoven.
Figure 6 below represent a counterfeit
Microsoft COA.

Notice
in figure 6 the foil strip does
not appear to be part of the actual
paper but simply positioned behind
it. This is also demonstrated by
the clear transition between the
paper and the foil within the cut
holes. So how do they attempt to
replicate the interwoven thread?
You will be somewhat surprised at
the simple technique they use as
shown below in figure 7.

To
the left, figure 7 clearly
demonstrates how counterfeiters
attempt to integrate the foil
strip into the COA. They simply
take a foil strip and apply
it to the back of the fake
COA using of all things...
scotch tape! An individual
could simply remove the foil
strip from the COA!
If
you were to look at the back
of a genuine Microsoft COA,
that foil would be woven into
the paper itself and impossible
to remove because its actually
part of the COA, not a separate
individual piece.

Now
that we have covered counterfeit
COAs, lets move onto my favorite
technique of detecting counterfeit
Microsoft software. This one you
are going to love!
MEDIA
(CD/DVD DISKS)
Microsoft has taken extraordinary
steps in manufacturing their media
resulting in a disc that is impossible
to replicate. I personally believe
Microsoft's anti-piracy methods
of making discs are as effective
as the steps taken by our government
in relation to paper currency.
Sure I could go into all the minor
details of how to determine if Microsoft
media is counterfeit. But I am not
going to do that. If you care to
review the minor ways of detecting,
I will leave links in the Additional
Resources section at the end of
this article. For now, lets concentrate
on the one simple test that can
be performed on any Microsoft media.
Microsoft
embeds their labels directly into
the media. Meaning, they do not
burn the media and then place a
sticky label on top of it. The actual
label and all other printed material
is actually part of the media itself
and is impossible to remove.
Counterfeiters have not come close
to matching this technology that
Microsoft incorporates into their
media products. Rather, what counterfeiters
do is spray paint a bronze metallic
spray onto a label and then cover
the sprayed label with a clear plastic
label. This clear plastic label
prevents the paint from being scratched
by the unsuspected buyer.
With that said, lets now learn the
fool proof test of detecting if
Microsoft software is genuine or
counterfeit. This test holds true
for all Microsoft software and should
always be done no mater where you
purchased your software. Its a very
simple test that only takes a few
seconds. On the outside edge of
the disc, use your fingernail and
move it across the media toward
the center of the disc while attempting
to pull up a label. If the media
is genuine, you will not catch any
label edges and no label will rise.
If you do come across an edge and
a label begins to rise up, you are
a victim! With my personal experiences
with counterfeit software, I can
now detect it quickly by just running
my fingernail across the media to
detect an edge where a label would
start. In some cases I have seen
some really poor counterfeits where
you can visually see air bubbles
under the label! Last year I was
shown a counterfeit Windows 7 disc
which had a hair underneath the
actual label!
Figure 8 below demonstrates a counterfeit
media with the label being removed.
By
following the two simple steps I
have provided above, there is absolutely
no reason you should become a victim
of installing counterfeit software.
Now having the tools to detect counterfeit
software on your own, lets move
on to the steps you can take if
you have become a victim.
Steps to
take when you are a victim of counterfeit
software
I cannot express enough
how critical it is to report your
purchase of counterfeit software
to Microsoft. By doing this, you
not only help keep software prices
down but more importantly aid Microsoft
in tracking down and prosecuting
these sellers!

|
Introduction and origins of branded
software
Beginning
2011, an incredible increase in branded
software sales online was evident! I
find it simply amazing how many companies
I see online today participating in
this illegal activity. You may ask yourself,
why would companies embark on such a
risky illegal activity. The answer to
that questions is simple, PROFITS!
The illegal trade of branded software
brings in large profits. The sellers
of such software purchase them on the
black market well below the price legal
Microsoft software can be purchased.
For example, Dell branded Windows XP
Professional can be purchased at $25.00
and then resold for $75.00+. Dell branded
Windows 7 Processional can be purchased
at $40.00 and resold for $90.00+. With
those types of profit margins, one can
easily see how and why this illegal
practice has taken off.
As I type this, I personally know of
many sellers listed on Google Product
Search which offer Microsoft branded
software. Why has nothing been done
about these sellers? Microsoft now understands
this ever growing problem and you can
expect to see lawsuits filed against
these sellers in the near future. .
Microsoft can take up to 6-10 months
building concrete cases against these
illegal sellers. Remember, you heard
it here first :)
My personal experience with customers
over the years, it appears a lot of
confusion exists as to what exactly
branded software is. Microsoft offers
their software products to large system
builders under a licensing contract
agreement called branding. These large
system builders include but not limited
to Dell, HP and IBM.
To simplify things, from this point
on I will refer to Dell as the large
system builder.
Under this agreed branding contract
between Microsoft and Dell, Microsoft
gives Dell the legal rights to manufacturer
Microsoft software with their company
name on it. Therefore, all Dell branded
Microsoft software will have the name
Dell on both the media and COA (Certificate
of Authenticity). The legalities do
not stop there!
Under this contract agreement, the Microsoft
software manufactured by Dell can be
sold/distributed only by Dell and only
in conjunction with a new Dell computer
system. This software cannot be sold
or purchased individually without the
inclusion of a new Dell computer system.
Furthermore, this Dell branded Microsoft
software cannot legally be installed
or used on a non-Dell computer system.
The selling or purchasing of branded
software individually is defined as
Piracy and is subject to a $225,000.00
fine per incident by the seller and
or buyer!
Legal replacement media (known as Reinstallation
Software) is ONLY available from Dell.
No other entities are authorized to
distribute ell branded software!
As a consumer, it is important for you
to understand that in the eyes of the
law, counterfeit and an individual consumer's
purchase of branded software both carry
the same legal consequences.
Importantly as stated above, the buyer
needs to be aware that by using illegal
branded software, they too are subject
to a Microsoft lawsuit and it does happen
to buyers. Why the buyer you ask? The
answer is simple. For example, on all
Dell branded Microsoft software it clearly
states, For Distribution Only With a
New Dell PC. This statement on the media
clearly puts responsibility in the buyers
corner. Furthermore, Dell is also seen
on the COA (Certificate of Authenticity).
It is the buyers responsibility to be
knowledgeable of what they have purchased
and the legalities of use.
Therefore, to legally use Dell branded
Microsoft software, the software must
first have come into your possession
with the purchase of a new Dell computer
system and that said software must only
be used with that specific computer
system.
Now that I have clearly defined what
branded software is and its legalities,
lets now move on to ways you can spot
branded software and if a victim, have
Microsoft replace your branded version
for an authentic version for FREE!!!
How to spot
Microsoft branded software
First let me start off by stating that
all versions of Microsoft software are
offered in a branded version. This includes
all Windows, Office, and Server software
products. The tips I give you in this
section hold true for all branded Microsoft
software. Therefore, you can use the
same techniques with Server 2008 vs
Windows 7 etc.
INSTALL GUIDES
As stated above, all branded software
comes with the system builders company
name on the media and COA. Additionally,
if the software includes a install guide,
that printed material will also include
the system builders name.
In Figure 9 below, you will find a packaged
Microsoft Windows XP Professional. Here
you can clearly see the statement, "For
distribution with a new Dell PC only"
located on the install guide.
As
mentioned above, not all Microsoft
branded software come packaged and
sealed with an install guide as shown
in figure 9. Lets move on to how to
spot branded software simply by analyzing
the COA and media.
CERTIFICATE OF AUTHENTICITY
Again, all branded Microsoft software
will include a product COA with the
system builders name on it. Furthermore,
this COA will have the product key
code which again, can only be used
with the Dell computer system it was
originally distributed with. Its so
important that you the consumer understand
that using just the branded Product
Key alone on a non branded computer
system is PIRACY! Below, figure 10
demonstrates a Dell branded Microsoft
COA. For obvious reasons, the product
key code has been blurred out.
MEDIA (CD/DVD DISKS)
As
previously mentioned, all branded Microsoft
software includes media which has the
system builder company name on it and
the statement, "For distribution
with a new (system builders name) PC
only". Another clue to help determine
if the media is branded by a major system
builder is you will see that the media
will have Reinstallation stated on it.
Below figure 11 demonstrates the three
factors to look for.
By
using the tips I have provided you above,
you should now have not only a clear
understanding of what branded software
is and it legalities, but more important,
how to recognize it. Now there are numerous
cases where the consumer unexpectedly
receives branded software after purchasing
what they believed to be genuine Microsoft
non branded software. In this case,
I have great news for you as outlined
below.
Steps to take
when you are a victim of branded software
First all victims of branded software
should always report these illegal sellers
to Microsoft. We as consumers cannot
let these sellers continue to victimize
unsuspected buyers and drive software
prices higher!
Now lets get to the good news if you
are a victim of branded software. Microsoft
will replace one piece of branded software
with one piece of genuine software.
This replacement is only offered once
per customer. Therefore, you cannot
make multiple purchases of branded software
and then expect Microsoft to replace
them all. They will only commit to one
piece per customer. By requesting this
replacement, you are not only exchanging
the software for legal software but
also letting Microsoft know who the
illegal seller is!
